TERMS OF BUSINESS - WEDDING PHOTOGRAPHY

The terms of business and contract detailed herein pertain to provision of photographic services for 1 wedding, and should be read and fully understood prior to signing. It is mutually agreed that these terms form an integral part of the contract, and that no variation or modification to this contract shall be deemed effective unless accepted by both parties and confirmed in writing.

BOOKING: A deposit of £150 (£50 for print only options) is required at the time of booking, along with your acceptance of terms and conditions by way of signed copy of the contract. Cheques should be made payable to Lambourne Images. A cooling-off period is effective 7 days from the signing of the contract, after which the deposit is non-refundable, the booking is classed as definite and the contract is in force. Where a contract is signed within 30 days of the wedding, the full fee becomes payable immediately, and is non-refundable.

BALANCE OF PAYMENT: The remaining balance becomes due no later than 7 days prior to the wedding ceremony.

FEES: The fee covers supply of photographic services in accordance with the chosen option. Payment for additional albums, proof books, digital media, reprints and/or enlargements becomes due in full at the time of ordering.

CREATIVE LICENCE: It is agreed that following joint consultation and agreement of your storyboard, you will subsequently grant us sole creative and artistic licence to best enable your requirements to be carried out without further redress to us. We will endeavour to accommodate all requests and any additional specific requests on the day, but cannot guarantee compliance - e.g. due to inclement weather, availability/willingness of any requested personnel, or any other occurrence beyond our reasonable control which may affect the portfolio.

VIEWING, COPYRIGHT & REPRODUCTION: Preview images are provided in electronic format, unless the preview book option is chosen from which selections for the album may be made along with any other orders. Any discs or books provided need not be returned. Reproduction rights remain with Lambourne Images unless purchased via one of the DVD options. The 1998 Copyright, Designs and Patents Act assigns copyright to the photographer. You may not therefore copy or reproduce – nor allow to be copied or reproduced - any image taken under this contract by any means whatsoever unless purchased via one of the DVD options. Purchase of images on DVD is accompanied by unlimited reproduction rights. Additionally, as copyright owners, we reserve the right to free reproduction of photographs taken under this contract for promotional/publicity purposes.

EXCLUSIVITY AND PRODUCTIVITY: We aim to discharge our professional duties with maximum courtesy and minimum delay. You should therefore advise guests wishing to take private photographs/video footage not to unduly hinder our work. We reserve the right to respectfully request guests to refrain from taking private footage at any time should it be considered detrimental to the professional service provided.

FORCE MAJEURE: In the unlikely event of photographic failure, liability shall be limited to a refund of all monies paid. No further claim will be considered at any time. Similarly, should we need to cancel this contract for reasons beyond our control, (e.g. death, injury, sickness, conflict, natural disaster etc.), liability shall be limited to a refund.

COMPENSATION: Following the 7 day cooling-off period, should the contract be cancelled for whatever reason, to compensate for loss of income, the following charges will apply as a percentage of the total fee due and become due immediately following notice of cancellation.

Number of days before the wedding

· 30 days or less: 75%

· 31-90 days: 50%.

· 91+ days: 25%.

If the cancellation is deemed a postponement, then subject to availability, all monies paid to date may be credited against the new date. Total fees payable shall be those applicable at the time. In the event of unavailability for the revised date, a refund of monies paid, less the non-returnable deposit, shall be made.

QUERIES : We endeavour to respond to any query, either before or after the ceremony within 48 hours of receipt.

PRIVACY: In accordance with the 1998 Data Protection Act, contact details will be retained along with digital images for the purpose of image identification/orders for a period of two years. No personal details will be made available to a third party at any time without prior permission.

TO BE SIGNED BY THE CLIENT AND RETURNED TO LAMBOURNE IMAGES:

I/We declare that I/we have read, understood and retained the terms of business, and that we are in full agreement with them. I/We accept that endorsement of these terms and conditions with signature(s) forms a legally binding contract and shall signify that :

· I/We agree the terms and conditions contained herein are effective immediately upon signing.

· I/We agree that the deposit is non-refundable 7 days after the signing of the contract..

· I/We agree to the rates of compensation due should the contract be cancelled by me/us for whatever reason.

· I/We agree that reimbursements due from Lambourne Images for whatever reason is limited to a maximum refund of monies paid (less non-returnable deposit).
